(iii) the transfer of the pots into the cask/s.

II.2.1)Total quantity or scope:
The contractor will provide the supply and services mentioned in II.1.5. In particular, cask/s to store the pots and the ancillary system necessary to handle the container in the final storage area shall be provided.
The design and temporary/definite supply of tools and equipment necessary to perform the repacking activity is included in the extent of the contract, as well as the production of licensing documentation and support during the licensing procedure: inter alia, to obtain transport and storage authorisations.

Range: between 6 000 000 and 9 500 000 EUR

III.1.3)Legal form to be taken by the group of economic operators to whom the contract is to be awarded:
Requests to participate: all eligible natural and legal persons or groupings of such persons may apply. The grouping may be permanent, legally established or having been constituted informally for a specific tender procedure. All members of a grouping (i.e. the main contractor and all other members) are jointly and severally liable to the contracting authority. Tenders may be submitted by groupings of economic operators that, if awarded the contract, may be requested to assume a legal form by incorporation, partnership or otherwise which will enable them to contract as a single entity. A grouping of economic operators, however, must identify a leader (main contractor) which will interface between the Commission and the economic operators both during the procurement phase and during the contract execution. Therefore the grouping must provide a declaration to identify the leader and the other members and which empowers the leader to submit an offer or to sign a contract on behalf of and representing the whole grouping.
Groupings must provide the documents and information required in points III.1.4(d) and (e), and III.2.1 for each individual member thereof and for subcontractors.
In the case of a joint offer by a grouping:
— the criterion in point III.2.3(b) must be satisfied at least by the leader which must ensure that the performance provided by other members of the grouping complies with an equivalent quality standard,
— the criteria in points III.2.2, III.2.3(a) and (c) apply to the grouping as a whole.
The participation of an ineligible natural or legal person will result in the automatic exclusion of that person. In particular, if the ineligible person in the sense of the conditions set out in point III.2.1 belongs to a grouping, the whole grouping will be excluded if it doesn't fulfil all selection criteria without the excluded member.
III.1.4)Other particular conditions
The performance of the contract is subject to particular conditions: yes
Description of particular conditions: a) for any given industrial and/or commercial group only 1 request to participate can be submitted, either by 1 group member or by a combination of the group's members. For the sake of clarity 2 companies are considered to be part of the same industrial and/or commercial group or organisation if one of the 2 controls the other, e.g. owns more than 50 % of the shares of the other, or if more than 50 % of their shares belong to a common direct or indirect shareholder, except otherwise proved with appropriate evidence;
b) number of requests to participate per candidate: no more than 1 request to participate can be submitted by a natural or legal person whatever the form of participation (as an individual legal entity or as leader or member of a consortium submitting an application). In the event that a natural or legal person submits more than 1 request, all requests in which that person has participated will be excluded unless evidence is provided that competition is not hindered in any way;
c) shortlist alliances prohibited: any tenders received from tenderers having in the tendering phase a different composition than the ones in the requests to participate in the candidature phase will be excluded from this negotiated tender procedure, unless prior approval from the contracting authority has been obtained;
d) conflict of interest: economic operators shall demonstrate that they are not in a situation of conflict of interest when taking part in this call for tender, in particular those having assisted JRC Ispra in the preparation of the documentation related to this project;
e) candidates (main contractor and partners, in case of a grouping, and the subcontractors) must include in their request to participate a confidentiality declaration according to the template documents mentioned in Section VI.3(b);
f) at the JRC Ispra site, Italian law is in force on nuclear and health & safety issues. In particular contracts must be executed in compliance with Legislative Decree No 230/95 'Attuazione delle direttive Euratom 80/836, 84/467, 84/466, 89/618, 90/641, e 92/3 in materia di radiazioni ionizzanti' and its subsequent modifications and/or integrations, Legislative Decree No 241/00 'Controllo della radioattività ambientale e naturale tramite rilevamento in atmosfera, nelle acque, nel suolo', and Legislative Decree n. 81/08 'Attuazione dell'articolo 1 della Legge 3.8.2007, n. 123 in materia di tutela della salute e della sicurezza nei luoghi di lavoro' and its subsequent modifications and/or integrations;
g) with reference to Article 148.7 of Commission Delegated Regulation (EU) No 1268/2012 of 29.10.2012 on the rules of application of Regulation (EU, Euratom) No 966/2012 of the European Parliament and of the Council on the financial rules applicable to the general budget of the Union (OJ L 362 of 31.12.2012), the contracting authority may require that certain critical tasks be performed directly by the tenderer itself or, where a tender is submitted by a consortium of economic operators as referred to in Article 121.5 of Regulation 1268/2012, a participant in the consortium. On this basis, please consider carefully the following point (h);
h) subcontracting: manufacturing of the cask/s may not be subcontracted. The provision of the other services of this procurement may be subcontracted. In case of subcontracting, a letter of undertaking must be provided, in which the proposed subcontractor states its unequivocal will to cooperate with the candidate/tenderer.
In relation to the points III.1.4(d) and (e), and III.2.1, each subcontractor is also due to comply with the requirements specified therein.
The Commission reserves the right to assess the application of the selection criteria to the proposed subcontractor as appropriate.
In case a subcontractor is proposed in the tendering phase, the Commission reserves the right to apply the exclusion and selection criteria taking into account the value of the tasks to be subcontracted and their nature.
III.2)Conditions for participation
III.2.1)Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers
Information and formalities necessary for evaluating if the requirements are met: Tenderers will not be eligible to take part in this contract award procedure if they are in any of the exclusion situations listed in Articles 106 and 107 of Council Regulation (EC, Euratom) No 966/2012 of 25.10.2012 (OJ L 298 of 26.10.2012). According to this provision tenderers are required to submit a declaration on their honour. The template is available at the link provided in Section VI.3(b).
Should a contract be awarded, the contractor will need to provide the supporting documents required in Article 143(3) of Commission Regulation No 1268/2012.
In the case of groupings, they must provide the documents and information required in this paragraph for each individual member thereof and for subcontractors.
III.2.2)Economic and financial ability
Information and formalities necessary for evaluating if the requirements are met: Declaration on the tenderer's turnover realised in the past 3 financial years with a copy of the balance sheets and profit and loss statements or extracts thereof for the last 3 financial years.
Minimum level(s) of standards possibly required: a) the tenderer must have an average annual turnover over the last 3 financial years of at least 8 000 000 EUR;
b) at least 3 of the criteria found in Appendix 3 (see template available at the link provided in Section VI.3(b)) must be satisfied, FS1 and FI1 being mandatory.
III.2.3)Technical capacity
Information and formalities necessary for evaluating if the requirements are met:
a) a list of past similar projects relevant to the scope of the project;
b) DIN-EN-ISO 9001 certification or equivalent relevant to the contract;
c) a list of professional qualifications (up-to-date and signed CVs) of the people intended to be responsible for providing the service.
Minimum level(s) of standards possibly required:
a) i. at least 3 different projects regarding design of components and fabrication of special shielded containers for transport and storage of spent nuclear fuel or vitrified high-level waste over the past 15 years, for a total aggregate minimum of 10 000 000 EUR; and
ii. at least 1 transport licence released by national competent authorities in compliance with ADR prescriptions regarding 1 model of shielded transport packages for spent nuclear fuel designed and manufactured by the tenderer; and
iii. at least 2 projects on handling of spent fuel items in hot cell and at least 2 projects regarding underwater handling of spent fuel pins or spent fuel assemblies in reactor's decay pond over the past 15 years, for a total aggregate minimum value of 1 000 000 EUR;
c) i. at least 3 persons with at least 10 years' experience on design and fabrication of special shielded containers for transport and storage of spent fuel or vitrified high-level waste in the nuclear industry over the past 15 years; and
ii. at least 1 person with at least 10 years' experience on licensing process of special shielded containers for transport and storage of spent fuel or vitrified high-level waste in the nuclear industry over the past 15 years (experience with Italian authority will be considered an additional asset), and
iii. at least 2 operators with at least 5 years' experience on handling and conditioning of high-level radioactive material or spent nuclear fuel in hot cell and decay ponds over the past 15 years.
The contracting authority reserves itself the right to perform interviews with up to 3 people selected within the submitted list to verify the CVs. If one of the interviews reveals that a person does not meet the minimum levels required defined in point (c) hereafter, 1 and only 1 further interview of another person will be made. If the result of this further interview reveals that the said person does not meet the minimum levels required, the company will not be qualified.
